HealthyStart offers website design, client management, customized health plans, and business resources. While we take data privacy seriously and use secure practices, HealthyStart is not currently HIPAA-compliant. Users should avoid storing or transmitting sensitive health information subject to HIPAA regulations through our platform.
You must be at least 18 years old to use our Services.
By using our Services, you confirm that you are authorized to enter into a binding agreement.
When using our Services, you agree to:
Provide accurate, complete information.
Maintain confidentiality of account credentials.
Use the Services lawfully and ethically.
Only provide advice within your professional qualifications and certifications.
Safeguard client information and ensure your use of the platform complies with any applicable data protection laws in your region. You are responsible for ensuring that no sensitive health data requiring HIPAA compliance is submitted through the platform.
Notify HealthyStart of any data breaches or unauthorized access.
Refrain from using the platform for any unlawful, harmful, or fraudulent purposes, including sending spam, infringing on intellectual property, or disrupting platform operations.
Subscriptions are billed on a monthly or yearly basis.
Payments are non-refundable unless otherwise stated.
HealthyStart reserves the right to adjust fees with prior notice.
HealthyStart retains ownership of all content, tools, and designs.
Users may not copy, modify, or distribute HealthyStart’s intellectual property without permission.
You have the right to:
HealthyStart is not liable for indirect or incidental damages arising from your use of our Services.
Total liability is limited to the amount paid for the Services.
No Liability for User Actions:
HealthyStart is not liable for any damages, losses, or injuries arising from your use of the Services, including but not limited to:
Providing advice or recommendations beyond your area of expertise or certification.
Failing to comply with applicable laws, including data protection regulations such as GDPR. HealthyStart is not responsible for user-submitted data that violates HIPAA or similar healthcare-specific privacy laws.
Misuse of client information, including breaches caused by your actions or negligence.
c. No Liability for Third-Party Tools or Integrations:
We may provide access to third-party tools or integrations. HealthyStart is not responsible for the actions, content, or performance of these third-party providers. Use of such tools is at your own risk.
d. No Liability for Indirect Damages:
HealthyStart shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of profits, data, or goodwill, even if advised of the possibility of such damages.
e. Limitation of Financial Liability:
To the fullest extent permitted by law, HealthyStart’s total liability for any claims, damages, or losses shall not exceed the amount you have paid to HealthyStart for the Services in the preceding 12 months.
f. User Assumption of Risk:
By using our Services, you acknowledge that you do so at your own discretion and risk. HealthyStart is not responsible for any adverse outcomes resulting from your use of the platform, including decisions made based on tools, content, or recommendations provided through the Services.
You may cancel your subscription at any time by providing written notice to [email protected]. However, cancellation requests require a minimum of 90 days' (3 months') advance notice prior to your next billing cycle. During this notice period, your account will remain active, and all applicable subscription fees will continue to apply.
No partial refunds will be issued for unused time within the notice period. Failure to provide adequate notice will result in continued billing until the 90-day cancellation period has elapsed.
Healthystart reserves the right to cancel or suspend access to the Services for violations of these Terms or misuse of the platform without advance notice.
Healthystart reserves the right to suspend or terminate accounts for violations of these Terms.
Disputes will be resolved through binding arbitration in Ontario. Users waive the right to class-action lawsuits.
These Terms are governed by the laws of Ontario.
HealthyStart may update these Terms periodically. Continued use of the Services constitutes acceptance of the revised Terms.
Your use of the Services is also governed by our Privacy Policy.
You retain ownership of any client or business data uploaded to the platform. However, you are solely responsible for ensuring the accuracy, legality, and appropriate use of such data within your region’s regulations.
From time to time, we may offer access to beta features or experimental tools. These features are provided “as-is” without warranty and may be modified or removed at any time.
Healthystart may occasionally experience scheduled or unscheduled downtime for maintenance or updates. While we strive to minimize disruption, we are not liable for business interruptions or data loss due to downtime.
By submitting feedback, testimonials, or reviews, you grant Healthystart the right to use this content for marketing or promotional purposes, unless you request otherwise in writing.
